Prishtinë 23, prill 2014 – Sot me 23 Prill 2014 nën organizimin e Ministrisë së Tregtisë dhe Industrisë dhe Ministrisë së Integrimit Evropian, u mbajt takimi i Komisionit Ekzekutiv “Tregu i Brendshëm, Konkurrenca dhe Mbrojta e Konsumatorit”, me ç’rast u diskutua për progresin dhe zhvillimet ne fushat e Tregut të Brendshëm dhe Tregtisë, konkurrencës, prokurimit publik dhe të drejtave të pronësisë intelektuale.
Gjatë takimit, Ministria e Integrimit Evropian prezantoj draft kontributin e ofruar nga institucionet respektive për Raportin e Progresit 2014. Pjesëmarrësit u dakorduan për progresin e arritur sipas fushave në vijim:
Tregu i Brendshëm dhe Tregtia
Nga takimi në fjalë u konfirmua që ka pasur zhvillime të rëndësishme gjatë periudhës së raportimit në tregtinë e jashtme. Në pjesët tregtare të MSA-së, autoritetet kanë identifikuar dhe negociuar me sukses pjesën tregtare te marrëveshjes. Gjatë raundeve të negociatave teknike, mekanizmat konsultative të politikave të tregtisë janë shfrytëzuar për të marrë inputin nga shoqatat e biznesit, odat ekonomike dhe palët tjera të interesuara. Në anën tjetër, janë përmbyllur me sukses negociatat për marrëveshje te tregtisë se lire me Turqinë.
Sa i përket Infrastrukturës së Cilësisë, u konfirmua progresi i arritur në kornizën legjislative, me që rast janë miratuar disa Udhëzime Administrative dhe Rregullore per implementim efektiv te legjislacionit.
Perfaqesuesit diskutuan per forcimin e kapaciteteve administrative, bashkëpunimin përfshirë nënshkrimin e një Marrëveshje Bashkëpunimi në mes të Shoqatës Amerikane për Testim të Materialeve dhe Agjencisë Kosovare të Standardizimit, si dhe një numër trajnimesh dhe aktivitete tjera të cilat synojnë të rrisin profesionalizimin e mëtutjeshëm të stafit në këtë fushe.
Sa i përket kapaciteteve teknike, është konfirmuar themelimi i laboratorit të Gjatësisë dhe Presionit si dhe ngritja e kapaciteteve teknike të laboratorëve që bëjnë matjen elektrike dhe analizën e metaleve të çmuara.
Në aspektin e zbatimit të infrastrukturës së cilësisë, u konfirmua që gjatë periudhës raportuese janë adoptuar 1104 standarde si dhe janë realizuar një numër aktivitete për ndërgjegjësimin e publikut në lidhje me zbatimin e standardeve. Përveç kësaj, janë akredituar dy trupa të vlerësimit të konformitetit (TVK), janë mbikëqyrur 19 TVK, janë realizuar dy vizita vlerësuese në laborator testues që presin mbylljen e jo-konformiteteve, si dhe janë pranuar 8 aplikacione të reja për akreditim. Tutje, janë kalibruar të gjithë etalonët primar të laboratorit të masës, atij të matjeve elektrike dhe laboratorit të termometrisë. Janë bërë nje numer i konsiderueshem i inspektimeve për mbikëqyrje te zbatimit të rregulloreve teknike. Në këtë kontekst u konfirmua që databaza për shkëmbimin e informative dhe inspektimit të tregut në mënyrë elektronike është funksionale si dhe është bërë publikimi i 3 doracakeve për të siguruar zbatimin e direktivave dhe rregulloreve të transpozuara nga BE.
Sa i përket Mbrojtjes së Konsumatorit, u konfirmua që 1 rregullore është miratuar, një zyrtar shtesë është punësuar, Këshilli për Mbrojtje të Konsumatorit është takuar në mënyrë të rregullt si dhe janë pranuar gjithsejtë 132 ankesa gjatë periudhës raportuese.
Sa i përket Lëvizjes së Lirë të Punëtoreve, u prezantua miratimi i Ligjit për të Huajt dhe 3 Udhëzimeve Administrative, themelimi i Divizionit për Marrëveshje Bilaterale në fushën e Sigurimeve Sociale si dhe nënshkrimi i dy Marrëveshjeve Bilaterale në po të njëjtën fushë me shtetet e regjionit.
Sa i përket Lëvizjes së Lirë të Shërbimeve, u konfirmua që janë themeluar 3 grupe punuese për të lehtësuar procesin e transpozimit të Direktivës së Shërbimeve si dhe takimi i mbajtur i Grupit Koordinues për Harmonizimin e Legjislacionit mbi Shërbimet.
Sa i përket Te Drejtes se Themelimit, u konfirmua miratimi i Ligjit për Investime të Huaja.
Sa i përket Lëvizjes së Lirë të Kapitalit, u konfirmua që janë miratuar 7 rregullore për mbikëqyrjen e Institucioneve Mikro financiare, që bankat e lidhura me kode SWIFT kanë riemëruar kodet e tyre
për të pasqyruar kodin e shtetit të Kosovës. BQK është anëtarësuar në Organizatën Ndërkombëtare “Financat Ndërkombëtare për Fëmijë dhe të Rijnë si dhe janë punësuar 15 zyrtar të rijnë gjatë periudhës raportuese. Banka Qendrore po ashtu këtë muaj ka nënshkruar marrëveshje bashkëpunimi me Bankën Qendrore Evropiane. Kjo marrëveshje është shume e rëndësishme pasi qe ofron kornizën e bashkëpunimit midis BQK dhe Bankave Qendrore te shteteve anëtare te BE përmes Bankës Qendrore Evropiane.
Ne fushën e konkurrencës u konfirmua progresi në fushën legjislative me miratimin e Ligjit No. 04/L-226 për Mbrojtjen e Konkurrencës. Përderisa në aspektin e kapaciteteve institucionale është arritur progres në themelimin e Zyrës për Ndihmën Shtetërore ku është rekrutuar udhëheqësi i zyrës dhe një zyrtar , por që mbetet për tu plotësuar me staf në të ardhmen. Ndërsa në aspektin e implementimit Autoriteti Kombëtar i Konkurrencës në kuadër të mandatit qe ka, shqyrtoi (11) kërkesa për mbrojtjen e konkurrencës dhe konsumatorit.
Sa i përket fushës së prokurimit u konfirmuar po ashtu progresi në fushën legjislative me miratimin e Ligjit Nr.04/L-237 mbi Prokurimin Publik në Republikën e Kosovës. Sa i përket implementimit, KRPP ka kryer procedurat e prokurimit sipas ligjit ku në total ka dhëne 12,551 kontrata,gjegjësisht 87.86% me procedure të hapur ndërsa 5.60% me procedure të negociuar /me marrëveshje. Eshte diskutuar per numrin e rasteve qe nuk u janë përmbajtur rregullave dhe udhëzimeve për PP, dhe monitorimin e autoriteteve të prokurimit.
Janë emëruar anëtaret e Organit Shqyrtues te Prokurimit (OSHP) nga Kuvendi me 19 Mars 2014, ku jane pranuar 469 ankesa nga operatoret ekonomik, 254 prej tyre kanë përmbushur kriteret ligjore për tu shqyrtuar, në përputhje me LPP-në.
Sa i përket Të Drejtave e Pronësisë Intelektuale, u konfirmuar po ashtu progresi në fushën legjislative me miratimin e dy udhëzimeve në implementimin e Ligjit për Indikatorët Gjeografik dhe Vendin e Origjinës.
Sa i përket implementimit në fushën e të drejtës së pronësisë intelektuale u konfirmuar qe është funksionalizuar databaza e Agjencisë për Pronësi Intelektuale ku janë futur të dhënat gjegjësisht 378 marka tregtare, 44 patenta dhe14 dizajnë industriale. Agjencia për Pronësi Industriale ka pranuar 1,457 aplikacione në marka tregtare, 107 në patenta, 27 në dizajn industrial dhe 1 aplikacion në indikatorë gjeografik.
Sa i përket masave implementuese rreth mallrave të falsifikuara nga Doganat e Kosovës, u konfirmuar qe janë kryer kontrolla në 54 raste, ku janë krijuar 20 profile të reja të riskut, dhe (3) raste ex-officio. Për ta ngritur numrin e profileve të riskut, ato janë zhvilluar në sistemin elektronik të Doganës. Sa i përket të drejtës së pronësisë intelektuale u konfirmua që janë mbajtur gjithsejtë 11 trajnime në fushën e IPR-it për të gjitha institucionet si dhe janë realizuar 3 vizita studimore.
Kontributi për Raportin e Progresit do të dorëzohet Komisionit Evropian zyrtarisht me 2 maj 2014. Kjo do të përbenë kontributin e parë të institucioneve për vitin 2014, ndërsa kontributi i dytë dhe final do të dorëzohet me 1 shtator 2014.
