Government approved two decisions that advance Kosovo’s European agenda

Prishtina, 3 April 2015 – Government of Kosovo issued today two decisions that are directly related to the advancement of Kosovo in two main priorities of the European agenda for this year. It is about the approval of the Draft-law on Interception of Telecommunications, which is related to visa liberalization process and approval of the decision to initiate the preparation of the National Programme of the Republic of Kosovo for the Adoption of the European Union Acquis, which is related to the implementation of the SAA.

The Draft-law on Interception of Telecommunications regulates the procedures and conditions on the interception of telecommunications, which are conducted for the needs of criminal procedure by state institutions established under the law, as well as procedures and conditions for the purposes of interception for the needs of intelligence structures, established under the law.

Whereas the Minister of European Integration, Mr. Bekim Çollaku, explained to the Cabinet that this draft-law lays down the rules, obligations and procedures for Network Operators and Service Providers in relation to the processing of certain data. “Also, the obligations and authorizations of state institutions established under the law are laid down to ensure the respect for human rights and freedoms in the process of lawful interception, as well as the control of the implementation of interception procedures,” he added.

A very important aspect regulated by this law is the protection of rights and the work of journalists in terms of protecting the information resources.

Ministry of European Integration, during the period February and March, has led a comprehensive consultative process with key stakeholders in order to improve the Draft-law on Interception of Telecommunications, in the third attempt to issue such a law.

Whereas the drafting of the National Programme is one of the basic legal obligations arising from the draft Stabilization and Association Agreement, namely Article 74, which, inter alia, specifies that: “Kosovo will ensure that national legislation will be approximated with the EU acquis…The approximation will be conducted based on the programme agreed by the European Commission and Kosovo.”

Whereas, Minister Çollaku announced that the approval by the Government Cabinet of the decision to initiate the preparation of this programme will be followed by a complex, technical and long process of the preparation of the National Programme, which will be the main strategic document for the implementation of European Agenda until Kosovo’s full membership in EU.
